User agreement

About

www.sciarium.com (the Website) is a service that uses a web interface located only at 
https://www.sciarium.com
, and specialized hardware and software to provide storage, accumulation, transmission, and processing of materials submitted by Users in electronic form for public access, with the availability of the latest unique accounts in which the Users materials are stored.

1. About User Agreement

This User Agreement shall enter into force after clicking the «Signup» button on the new user sign-up form and is valid for the entire time the User uses the Website.
The Administration reserves the right to change the User Agreement without any notification to the Users.
The new version of the User Agreement shall enter into force 3 (three) days after its placement on the website unless otherwise provided by the new version of the User Agreement.

2. Limitations of Liability

The User expressly agrees that he uses the Website at his own risk.
The Administration cannot control the content and safety of materials posted on the Website, therefore, it is not responsible:
  • for the content of materials received by the User as a result of using the Website, their possible non-compliance with applicable law, offensive nature;
  • for the consequences of the use, application, or non-use of the information received;
  • for the possible incompleteness or inaccuracy of the information received;
  • for the possible inconsistency of the results obtained when using the Website with the expectations of the User;
  • for any damage to the User's equipment or software resulting from the use of the Website;
  • for the inability to use the Website for any reason;
  • for the consequences that may result from the distribution of illegal or unlicensed materials, as well as other products and information affecting the rights of third parties.
Under no circumstances will the Website be liable to the User or third parties for damage, loss, or expense incurred in connection with this Website, its use, or inability to use, including lost profit.
The User agrees not to transfer to other persons his credentials obtained during signup (login and password) for login/identification to the Website and is fully responsible for the loss, disappearance, or another way of transferring credentials, as well as for consequences associated with by this act.
The Website Administration is not responsible for the actions of third parties who have used the credentials of the User.
The Website Administration does not bear any obligation to ensure confidentiality concerning the information provided to its Users, although it takes all possible measures to this.
The Website is not required to control the legality or illegality of the information transmitted (any, including, but not limited to, internal transfer between Users in the form of various links, texts, or images); determination of ownership rights or the legality of the transfer, acceptance or use of this information.
The User agrees that he is responsible for the information posted by him on the Website, and also assumes all possible legal consequences from the transmission, reception, or use of this information.
The User agrees that any materials posted by the User on the Website in the public domain can be used by the Website at its discretion without paying any remuneration to the User.
The User agrees that his contact details specified during the signup process and/or in the profile can be used by the Website to send service messages (signup confirmation, password reset, moderation results, etc.), to notify the User about the comments of other Users, as well as events in his profile.
The term «Download» in the framework of this project means the reproduction by the User of small work, short excerpt, or article (with or without illustrations) in a single copy without making a profit and at the request of an individual for educational or research purposes.

3. User Website Use Restrictions

When using this Website, the User has no right, and agrees with the following:
  • place files containing viruses or other computer programs that are known to be malicious, files or programs designed to violate, destroy or limit the functionality of any computer or telecommunications equipment or programs, to allow unauthorized access, as well as serial numbers to commercial software products and programs for its generation, logins, passwords and other means for gaining unauthorized access to paid resources on the Internet, as well as posting links to the above information;
  • post files of any messages, data, or programs whose use affects any patent, trademark, trade secret, copyright or property rights and other related rights of third parties;
  • post files whose contents are contrary to the current legislation of the Russian Federation;
  • post extremist materials and files whose content is aimed at inciting ethnic hatred;
  • send unauthorized advertising messages (junk mail, spam) to the email addresses specified on the Website;
  • copy and use for commercial purposes any information obtained through this Website that violates the rights of other Users or which could cause them direct material or moral damage;
  • impersonating another person or a representative of an organization and/or community without sufficient rights for that, including employees of the Administration and the owner of the Website.
The User agrees not to reproduce, duplicate or copy, sell or resell, or use for any commercial purposes any parts of the Website, the use of services, or access to them, except when such permission has been given to the User by the Website Administration.
The Website Administration does not bear any responsibility under any agreements between the User and third parties.
The User has the right to terminate relations with the Website and refuse to use its services, using the special interface following the instructions. In this case, the User's data will be deleted, access to services will be blocked.
The User agrees that the Website Administration reserves the right to stop servicing an account that the User has not used for 12 months. In this case, the User's information is destroyed, and the User's signup is canceled.

4. Performance Guarantee

Access to the Website is provided on an «AS IS» basis without guarantees of any kind, either direct or indirect.
In particular, the Website Administration does not guarantee the operability of both the Website and its sections, as well as the operability and reliability of the links posted on it by its Users.
The resource is not responsible for any direct or indirect losses incurred due to: use or inability to use the service; unauthorized access to User communications.

5. Website Administration Rights

The Website Administration has the right to deny access to the Website to any User or group of Users without explaining the reasons for their actions and prior notification.
The Website Administration has the right to change, delete or block the posted files and other data posted by Users on the Website, without prior notice and explanation of the reasons for their actions.

6. Parties Liabilities

The User agrees that all possible disputes regarding this agreement will be resolved by Russian law.
The User agrees that all possible disputes regarding his activities on the Website will also be resolved by Russian law.
The User agrees that the rules and laws on the protection of consumer rights cannot be applied to the use of the Website, since he does not provide paid services.
The Website does not establish with users agent relations, partnerships, joint activities, personal hiring relations, as well as any other relations not expressly described in the User Agreement.
Inaction on the part of the Website Administration in case of violation by the User or group of Users of the User Agreement does not mean that the Website Administration is assisting the User or group of Users in such actions.

7. Personal Data Processing

The User confirms his consent to the processing of personal data provided during signup, as well as voluntarily posted by the User on his page. The processing of the User's data is carried out by the legislation of the Russian Federation.
The Website Administration processes the User's data to provide services to the User, including providing personalized (targeted) advertising, verification, research, and analysis of such data, allow to maintain and improve the services and sections of the Website, as well as to develop new services and sections of the Website.
The Website Administration takes all necessary measures to protect the User's data from unauthorized access, alteration, disclosure, or destruction. The Administration provides access to the User's data only to those employees, contractors, and Administration agents who need this information to ensure the functioning of the Website and the provision of Services to the User.
The Website Administration has the right to use the information provided by the User, including personal data, to ensure compliance with the requirements of the current legislation of the Russian Federation (including to prevent and/or suppress the illegal actions of Users).
Information provided by the User may be disclosed by the current legislation of the Russian Federation at the request of the court, law enforcement agencies, as well as in other cases provided for by the legislation of the Russian Federation.

8. Consent to the User Agreement

If the User does not agree with all of the above conditions, he does not have the right to visit the Website as a whole, or any part of it, except the page with the User Agreement, to receive and/or use the contents of this Website by any other means, either as a whole or in any part.
